o Napster to Block Unauthorized Copyrighted Songs

San Francisco -- Beginning this weekend, Napster will begin blocking
network access to thousands of copyrighted songs stored on its users' hard
drives, CNET reported on Friday. The announcement was made during a
hearing before U.S. District Court Judge Marilyn Hall Patel, held to
restyle the injunction she enacted against Napster that was essentially
upheld on appeal. Attorney David Boies said that Napster will begin
filtering its directory according to individual file names, and will
initially block "millions" of songs, including about 5,600 originally
submitted by the record label plaintiffs in their copyright infringement
suit against the company. "We have had a group of people working night and
day on a process to block access to these files," Boies said. "What we are
doing is inserting a step between the uploading and the viewing of the
index... that will block out specific file names." Judge Patel did not
give a ruling or offer an amended injunction at the hearing.

o NFL, MLB Join Justice Department, MPAA in Opposition to DeCSS

San Francisco -- The National Football League and Major League Baseball
have joined the U.S. Department of Justice in backing the Motion Picture
Association of America's (MPAA) lawsuit against a magazine that published
code able to crack the encryption security on DVDs, CNET reported. DeCSS
is a code -- originally designed to make DVDs playable on Linux computers
-- that can circumvent the security on DVDs, making them vulnerable to
copying and piracy. The MPAA sued and won a permanent injunction against
2600, a hacker-friendly magazine that published the code and linked to
sites where it was available online. An appeal was filed by the Electronic
Frontier Foundation, a group of privacy advocates who said the ban on
posting or linking to DeCSS impedes on First Amendment rights. In their
recent brief defending the MPAA's position, the NFL and other groups asked
the court to uphold its permanent injunction, saying that "unchecked, such
piracy threatens to destroy the legitimate marketplace for works of art,
music, film, software, literature and other video programming (including
sports programming), and will deter the development and distribution of
new works in state-of-the-art digital media." Oral arguments for the
appeal are scheduled for April.

o Streaming Audio Firm GlobalMedia.com Faces Nasdaq Delisting

Vancouver, B.C. -- GlobalMedia.com, a provider of custom Internet audio
streaming services for companies, has requested and been granted a hearing
before a Nasdaq Listing Qualification Panel, in response to a delisting
notice issued by the Nasdaq. The company's stock has been trading below
the $1 mark since October. Vancouver-based GlobalMedia.com recently sold
its radio assets as part of a restructuring and announced it would focus
on video delivery on the Internet for broadband and wireless markets. The
company's CEO and president resigned on February 1. GlobalMedia.com's
delisting has been stayed pending a hearing on March 30.

o Affleck, Damon-Backed Project Greenlight Names Film Contest Winner

New York -- Project Greenlight announced on Friday that 31-year-old Los
Angeles resident Pete Jones was awarded a $1 million budget from Miramax
Films, to create a feature-length film based on the script idea he
submitted online. "Stolen Summer" will be executive produced by Chris
Moore, Matt Damon and Ben Affleck, and directed by Jones. "When you're the
one picked out of ten thousand scripts it's a very humbling experience,"
said winner Pete Jones. "I hope I make all of these people proud." Affleck
and Damon launched Project Greenlight as part of their multimedia venture
LivePlanet, which has also created a reality series picked up by ABC.
Users submitted scripts online that were reviewed by the Project
Greenlight site's members; a number of scripts were then selected and
their writers were provided with tools like Avid software to shoot a short
version of their idea. From these shorts, Jones' movie was chosen for
production. In addition to providing the production budget and
distributing the film, Miramax will also shoot a behind-the-scenes making
of the film that will be aired on HBO.

o Briefly Noted:

(San Francisco) File-sharing service Aimster is using the language of the
Digital Millennium Copyright Act (DMCA) to protect its service from
suffering the same fate as Napster, Wired News reported on Friday. The
company -- which piggybacks on instant messaging services such as AOL's
AIM -- has released a new "terms of service" notice that legal experts say
may exempt them from the anti-piracy efforts of the RIAA. Technically, the
new terms of service make Aimster comply with the language of the DMCA --
legislation regulating digital copyrights that was enacted partially due
to lobbying efforts from the RIAA and record labels.

(Albuquerque, N.M.) Independent film production company Red Carpet
Productions on Friday announced MakeMyIndie, an online contest asking
users to submit scripts in the hopes that their idea will be made into a
feature film. The contest organizers plan to finance the film through
banner advertisements on the site. "This will be the first feature film
financed by Internet surfers without them actually loaning or investing
money," said Red Carpet president Ana Montoya. "We've dubbed this 'impulse
finance.'" New Mexico-based Red Carpet hopes to attract visitors who hear
about the site and wish to help in the production of a film to click on
the site's banner ads. Advertisers on the site will include A&E, AT&T,
Business.com, Dell, IRS.com and sites specifically related to
screenwriting, like Finaldraft.com and Screenplay.com.

(Tokyo) Sony said on Friday that it is abandoning a partnership with
Hitachi, Matsushita Electric Industrial and Toshiba to develop interactive
television, Wired News reported on Friday. The four companies had created
the ePF Network Corporation to develop standards for the technology,
including customer management and bill-collection systems. "We have
decided to go it alone in terms of providing services because we found
differences in ways of providing services," a Sony spokesman told Wired.
The ePF Network Corp. said that Victor, Sanyo Electric, and Sharp will
replace Sony.

(Montreal) FLIPR, the developer of a free peer-to-peer music-sharing
service that compensates artists, has announced the availability of a beta
version of its software. Montreal-based FLIPR (Future License of
Intellectual Property Registry) proposes to compensate artists with a $.04
royalty payment to copyright holders issued 30 days after a song is
downloaded. The company plans to create revenue through a more value-added
subscription version, advertising, the upsale of CDs and other
merchandise, direct marketing, market research and data mining, and
providing licensed content for wireless networks. So far, the company has
only attracted a group of smaller independent labels to participate, such
as Tiger Style and 75 Ark.

(Los Angeles) The creators of Gnotella, a peer-to-peer file-sharing
program based on the Gnutella protocol, have released an updated version
of the software that blocks a recently discovered virus aimed at
Gnutella-based networks. The company has licensed its software to
Florida-based Ebux, Inc., which said it is refocusing its business on
peer-to-peer networking and will change its name accordingly.

(Los Gatos, Calif.) Audible Magic, a developer of digital audio
identification technologies, has introduced software that can accurately
identify music streamed by
Webcasters and other Internet sites and generate a playlist based on the
songs played in real-time. The Los Gatos-based company is marketing its
technology to copyright owners, royalty monitoring associations, and music
labels looking to track the public use of audio content. Audible Magic is
currently beta testing the software and expects it will be available this
spring.
