o Kazaa Pays Over $115 Million to Settle All Copyright Litigation

Sydney, Australia - Sharman Networks, operator of the Kazaa peer-to-peer file-sharing network, announced on Thursday that it has settled all outstanding litigation with the movie studios and record labels that sued the company for copyright infringement. The Associated Press reported that under the terms of the settlement, Sharman will pay $115 million to record labels and an undisclosed smaller sum to the movie studios, and has agreed to "use all reasonable means" to discourage piracy on its network. "It has been our long standing goal for Kazaa to play a significant role in the growing market for licensed online distribution and authorized exchange of copyrighted content using peer-to-peer technology, and this settlement ensures that we will be working together with the content providers to the benefit of consumers, businesses and artists," said Sharman CEO Nikki Hemming. Sharman now plans to negotiate licensing agreements with the labels and studios to offer authorized downloads on Kazaa, an application that has been downloaded 389 million times and yielded thousands of copyright infringement lawsuits against its individual users. "Services based on theft are going legit or going under, and a legal marketplace is showing real promise," said Mitch Bainwol, chairman and CEO of the Recording Industry Association of America.

o EU to Probe Possible Antitrust Violations of Blu-ray, HD DVD Licenses

Brussels - The European Commission has launched an antitrust probe into the licensing schemes created by the developers of next-generation Blu-ray and HD DVD technologies, Reuters reported. The Commission said it is looking into whether licensing terms for the groups of patents held by companies that contributed to the development of Sony's Blu-ray and Toshiba's HD DVD violate EU competition rules, but did not provide further details on the requests for information it sent to the companies. Following the probe, the EU may either choose to launch a formal investigation, or discontinue the inquiry.

o Snocap Testing Service That Lets Bands Sell Songs on MySpace

London - Snocap, the digital music firm launched by Napster creator Shawn Fanning, is testing a service called "Linx" that lets bands sell their own songs from websites, Reuters reported. A band called The Format is already selling its music on the MySpace social network using the Linx system, which requires that purchasers first both register with Snocap, and have an electronic payments account with PayPal. San Francisco-based Snocap has secured agreements with all of the major labels and many independents, which have uploaded their catalogs to a registry that allows them to dictate licensing terms and distribute songs through online retailers and licensed peer-to-peer services.

o Interactive TV Emmy Awards Go to TiVo, ABC.com's Streaming TV

Los Angeles - TiVo and ABC.com's full episode streaming player were the recipients of this year's interactive TV Emmy Awards, announced today by the Academy of Television Arts & Sciences at the American Film Institute Digital Content Festival. TiVo won the Emmy for Outstanding Achievement for Enhanced or Interactive Programming: Television, beating out finalists including AOL Music on Demand, CNN Enhanced and DirecTV Interactive Sports. Disney's ABC.com launched a service in May that streamed full episodes of series like "Lost" and "Desperate Housewives" with commercials; while the service was taken off-line for the summer, the company is expected to re-launch it for the fall season. The ABC service won the Emmy for Outstanding Achievement for Enhanced or Interactive Programming: New Delivery Platforms, from among a field of finalists that included MLB.TV Mosaic, Starz's Vongo video download service, and Riddle Productions' "Danny Bowles and the Jade Treasure, Stranger Adventures."

o Google to Launch Version of Web Advertising Platform for Radio

San Francisco - Google plans to make its successful online advertising model available for the radio industry within three months, CNET News.com reported. The company paid $102 million in January to acquire dMarc Broadcasting, which developed an automated radio advertising system that will be integrated with Google's AdSense service for the radio initiative. The current radio advertising business requires advertisers to work through agencies that have relationships with individual radio stations, while Google's system will automate the process of buying, placing and tracking radio ads. The Google radio advertising service has already placed ads on the air at a station in Detroit; the company also signed a one-year agreement with broadcaster Greater Media, which will begin placing Google ads on some of its 19 stations over the next two months.

o XM Again Lowers Subscriber Estimates; Posts Wider Loss

Washington - For the second time in three months, XM Satellite Radio on Thursday lowered its year-end subscriber estimates. Citing "current marketplace dynamics" and "regulatory uncertainties" concerning some of its radios, XM -- which currently has just over 7 million subscribers -- said that it now expects to end 2006 with between 7.7-8.2 million subscribers. In May, the company originally lowered its forecast from 9 million subscribers to 8.5 million. The news came on a day when the company's second quarter earnings came in well below analyst forecasts. Despite nearly doubling its revenue to $227.9 million, the company reported a net loss of $231.7 million, up from $148.8 million a year ago. The company's stock rose 5.7% on Thursday as investors bet that the worst news is now behind XM's stock price.

Los Angeles - E! Entertainment announced on Thursday that it has made episodes of TV programs including "The Girls Next Door," "The Soup," "Dr. 90210" and "The Simple Life: 'Til Death Do Us Part" available for purchase and download from Apple's iTunes Store. The first episode of the second season of "The Girls Next Door" will be posted to iTunes on July 31, a day after it premieres on broadcast TV. Episodes of E! programs will sell on iTunes for $1.99 each.

o Accessory to Enable High-Definition Playback on Video iPods

Palo Alto, Calif. - ATO, a developer of iPod accessories, has introduced a display device that slips on to iPod Video players to allow playback of high-definition video, CNET News.com reported. ATO's iSee video sleeve HD player supports formats including MPEG 4, DivX and HD.264, and will retail for between $199 and $250 when it ships late this year. ATO has sold previous iterations of its iSee devices for iPods -- which are produced under a license from Apple -- at Wal-Mart and Best Buy.

London - British Telecom has signed an agreement with Universal to sell full-length films for download to the PCs of its broadband customers, The Register reported. About 150 films will be offered through the BTVision video-on-demand service. Purchasers will also receive a copy of the film formatted for Sony's PSP handheld game device, and a physical copy of the DVD through the mail. Universal struck a similar deal with U.K. DVD rental site Lovefilm.com, which charges about $37 per movie for the service.

Bebo, a social networking site popular in the U.K., announced on Thursday the launch of a music discovery feature, Bebo Bands. The service has already attracted 25,000 artists, who have created pages where they can upload an unlimited number of tracks and videos. The feature also allows Bebo members to create 20-song playlists of tracks found on the site, which can be heard by other members and listened to while moving from page to page across the site. London-based Bebo added that it has secured agreements with a number of major and indie record labels to provide unique music content for the site.

o Electronic Announces Development of "The Sims 2 Pets," LOTR Expansion

Electronic Arts on Thursday announced plans for "The Sims 2 Pets," an expansion pack for its PC game that will also be released for current generation console and handheld platforms. The game will allow players' Sims characters to design their own pets, which must be cared for, and can be taught to learn tricks. Separately, EA announced an expansion pack for its "The Lord of the Rings, The Battle for Middle-earth II" PC game. "The Rise of the Witch-king" will contain new content from J.R.R. Tolkien's original fiction, and is currently in development at EA Los Angeles for release in the fall.

Progressive Gaming International announced on Thursday that Cantor Gaming, a unit of financial services firm Cantor Fitzgerald, has licensed several of its mobile gaming titles for use on Cantor's mobile gaming system in Nevada. Cantor Gaming is the only company licensed to make mobile gaming devices in Nevada, which recently enacted legislation allowing the devices at its casinos. Progressive's "Texas Hold 'Em Bonus Poker" and "Caribbean Stud Poker" games will be available on modified PDAs on casino grounds; the company's Rapid Bet Live sports wagering system is also expected to be implemented.
