Search Ad Trademark Dispute
Mountain View, Calif. -- A federal court has asked Google and car
insurance firm Geico to settle a dispute over whether Google
violates Geico's trademarks by selling search ad listings for Geico
rivals that are triggered when users search for the terms "Geico",
CNET News.com reported. While the court ruled that Google did not
violate Geico's trademarks with the search terms, it said the use of
the words "Geico" and "Geico Direct" in the actual text of the
competitors' ads on Google search pages may violate Geico's
trademarks. However, Google may also claim that the ad copy text is
the responsibility of the advertisers who placed the ads in the
first place, or invoke a special exemption from trademark
infringements enjoyed by printers and publishers, Marquette
University Law School assistant professor Eric Goldman told News.com.

Basic Xbox 360 to Sell for $299, Premium Edition for $399
Redmond, Wash. -- Microsoft announced on Wednesday that its Xbox
360 will sell for $299 when it goes on sale in the U.S. this fall. A
premium version, with added 20GB hard drive, HDTV cable, wireless
controller, media remote and other features will go on sale
simultaneously for $399. European pricing for the Xbox 360 was also
revealed, with the core model to sell for 299 euro/209 pounds (about
$367/$378) and the premium model going for 399 euro/279 pounds
(about $490/$504). Both models will come with a free "silver" level
of membership to Xbox Live, the company's online game service, which
will enable gamers to chat online, send and receive voice messages,
and access online content like game demos and casual games from Xbox
Live Arcade.

Backs TiVo in Patent Dispute with Pause Technology
Alviso, Calif. -- TiVo announced on Wednesday that it has won a
patent dispute with Pause Technology, which sued TiVo in 2001 for
allegedly infringing its patent on technology used to rewind,
fast-forward and pause television programs. The U.S. Court of
Appeals for the Federal Circuit affirmed in a summary judgment a
Feb. 2004 U.S. District Court ruling, which found TiVo did not
infringe Pause's patent. "We are pleased with the Federal Circuit's
decision and the resolution that it brings to this matter," said
TiVo vice president and general counsel, Matthew Zinn. Alviso,
Calif.-based TiVo said it will additionally seek an order from the
District Court requiring Pause to pay all of TiVo's litigation
costs.

to Ship $99 Game Boy Micro in U.S. on Sept. 19
Redmond, Wash. -- Nintendo of America announced on Wednesday that
it will introduce its Game Boy Micro handheld video game system in
the U.S. on Sept. 19, with a price tag of $99. Measuring 4" by 2" by
0.7" and weighing three ounces, the device will come in silver and
black, with three removable vanity faceplate designs that double as
screen protection. The Game Boy Micro will play all of the 700-plus
titles available for Nintendo's original Game Boy handheld. Nintendo
also plans to release the Game Boy Micro in Europe on Nov. 4, with a
price tag of 99 euros ($122).

Film Studio Backs Sony's Blu-ray DVD Format
Santa Monica, Calif. -- Film studio Lions Gate announced on
Wednesday that it plans to support Sony's next-generation,
higher-capacity DVD format, Blu-ray Disc. Sony's Blu-ray is battling
to become the next-generation DVD standard with Toshiba's HD DVD, in
what is shaping up to be a format war similar to the one seen in the
1980's between VHS and Beta in the videocassette market. Earlier
this week, Twentieth Century Fox also pledged its support for Sony's
Blu-ray, joining Disney and Sony's own film studio. Lions Gate Home
Entertainment said it will release new films, TV programming and
other titles on Blu-ray DVD. Meanwhile, Universal Pictures,
Paramount and Warner Bros. have said they will release titles on the
rival HD DVD format.

Holland Commit to Less Restrictive Online Music Licensing
Brussels -- Two European nations have committed to ending thorny
licensing issues that make it harder in Europe to license music for
streaming on Internet radio and for sale from download stores,
Reuters reported. The Dutch royalty collection agency BUMA and
Belgium's SABAM have proposed commitments to end such restrictions,
which require online radio stations and download stores to seek
individual licenses to use songs from each country's separate
royalty agency. The European Commission last year released a
statement compelling 16 European nations to end their labyrinthine
licensing restrictions, saying that they are hampering the
development of the European online music market.

Internet Portal NetEase Suspends MP3 Search Service
Beijing -- Chinese Internet portal NetEase has shut down its MP3
search engine, saying it wants to prevent possible copyright
infringement, the Beijing Daily reported. The company stated that
its search engine was not directly responsible for copyright
infringement, but will suspend the service until it can guarantee
the rights of artists and copyright holders. NetEase rival Baidu.com,
which just raised $109 million in a U.S. IPO, also offers a similar
MP3 search engine.

Magazine Salon.com Looks to Sell Community Site The Well
San Francisco -- Online magazine Salon.com is looking to sell The
Well, the long-standing online community and e-mail service provider
it purchased in 1999, the company said in an SEC filing. "We're
diluting both our management and our resources by focusing on two
brands," Salon CEO Elizabeth Hambrecht told News.com. "Finding
another owner for The Well that will give it the resources it
requires and deserves is the way we'd like to approach this. We're
not looking for the first buyer out there -- we're looking for a
good match." San Francisco-based Salon said paid subscribers to the
ad-free, premium version of its news site have actually dropped,
from 20,900 a year ago to 15,300 in June 2005; subscription revenue
from its recent quarter was about $500,000, while the company's
overall revenue for the quarter fell from $1.7 million last year to
$1.6 million.

Micropayments Processor Peppercoin Raises $8 Million
Waltham, Mass. -- Peppercoin, a provider of online micropayment
processing services, announced on Wednesday that it has raised $8
million in venture capital financing. Wall Street Technology
Partners led the investment round; previous investor Pod Holding, a
Boston-based institutional investor, and several private individuals
also participated. The company additionally announced that it has
named current president Mark Friedman to the additional role of CEO.
Massachusetts-based Peppercoin provides online payment processing
for small transactions, for companies including digital music
services Mashboxx, Peer Impact and myMPO. The company will use the
funds to aid in the roll out of "several advanced capabilities in
coming months which enable a blend of prepaid, subscription,
pay-as-you-go and post-paid merchant offerings," said CEO Mark
Friedman.

Shuttle, Armstrong Help NASA, Nike Sites Soar in July
Reston, Va. -- Events such as the Discovery Space Shuttle launch
and Lance Armstrong's record-setting ride to a seventh Tour de
France victory drew Internet users to related web sites in droves
last month, according to new statistics by comScore Media Metrix.
NASA.gov shared the title as the Internet's highest-gaining property
in July, as traffic increased 60%. More than 4 million people
visited the site, which featured special "Return To Flight" content
with video, images and reports spanning topics such as crew
biographies, shuttle design and assembly. Shoe and apparel company
Nike, a long-time sponsor of Armstrong, also saw a 26% jump in its
site traffic to 3.5 million unique visitors. A large percentage
flocked to a page titled "Wear Yellow" that featured video clips
telling Armstrong's story of overcoming cancer to dominate the
cycling world.

Digital music service eMusic announced on Wednesday that it has
named chief operating officer David Parkman as president and CEO.
The company also named Danny Stein, president of eMusic owner JDS
Capital, as chairman of the board. New York-based eMusic also
announced that its paying subscriber base has now reached 100,000.
The company now sells more than two million tracks monthly, from its
library of 700,000 unprotected MP3 files from mainly independent

(Cumberland, R.I.) Numark Industries, a manufacturer of DJ
equipment, on Wednesday introduced its iDJ Mixer for Apple iPod
portable music players. The DJ mixing console features docks for two
