San Diego – MP3tunes, the digital music locker service
created by founder Michael Robertson, has filed a motion for summary
judgment in a copyright infringement lawsuit filed against it by major record
label EMI.

EMI alleged that MP3tunes’ locker service is infringing, as well as
Sideload, its music search engine that links directly to open MP3 files.

noted that the case "has enormous ramifications for the internet industry
because all the major net companies offer services which store media
files," providing as example Microsoft’s Skydrive and Apple’s iDisk.

adds that, "most of these copyright cases (Veoh, Youtube, Napster,
Grokster, etc) are decided without a jury trial but rather by a Judge at the
Summary Judgment phase which is where we’re at now."
