London – The U.K. Court of Appeal has upheld a lower court’s
ruling invalidating three patents held by TV electronic program guide maker
Gemstar (now owned by Rovi), which had sued Virgin Media for patent
infringement, Bloomberg reported.
Gemstar sued Virgin in 2008, and a judge in
2009 ruled that two of the patents in question were invalid; Gemstar did not
appeal over the third patent.
"We have vigorously defended our assertion
that Gemstar’s claim was unfounded and that they should not have brought this
case and the court agrees emphatically," Scott Dresser, general counsel
for Virgin Media, told Bloomberg.
Gemstar was acquired by Macrovision in 2008;
Macrovision later changed its name to Rovi.
