Fox Sues Movie Script Uploader for $12 Million

2

Los Angeles – News Corp.’s (NYSE:  NWS) Twentieth Century Fox movie
studio has filed a $12 million copyright infringement lawsuits against a
self-described struggling screenwriter who posted a number of movie scripts
online, TorrentFreak reported. Patricia (P.J.) McIlvaine uploaded some 100
scripts as a means of helping other screenwriters, including
"Aliens," "Wall Street" and "Deadpool," a film
owned by Fox that is still in development.

In its lawsuit, Fox claims that McIlvaine’s uploading of scripts "harm[s] the fans who do not want their enjoyment of a movie or television
show to be spoiled by knowing the story ahead of actually being able to watch
it."

Fox also sued a number of John Does,
seeking to identify the sources who provided McIlvaine with the scripts —
although McIlvaine maintains she merely re-uploaded scripts she found online.

"PJ
doesn’t have the kind of cash needed to hire an attorney," reads a post on
the blog Celluloid Blonde.

"Like I said, days she works a telephone line
selling flowers to make ends meet and nights she writes — fighting to bridge
that artist-who-does-art vs. artist-who-gets-paid-for-art gap. In between she
is caring for an elderly relative suffering from dementia. In between that she
is caring for an infant. She is going to need help."

File-Swappers File Class Action Against U.S. Copyright Group

0

Los Angeles – U.S. Copyright Group, which has filed
copyright infringement lawsuits against tens of thousands alleged to have
illegally downloaded movies such as "Far Cry," has been hit with a
class action lawsuit by over 4,500 of those sued, TorrentFreak reported.

The
class action lawsuit alleges "extortion, fraudulent omissions, mail fraud,
wire fraud, computer fraud and abuse, racketeering, fraud upon the court, abuse
of process, fraud on the Copyright Office, copyright misuse, unjust enrichment
and consumer protection violations" were committed by U.S. Copyright Group
in its efforts to extract settlement fees from alleged file-swappers.

The
lawsuit also brings to light the fact that "Far Cry" producers did
not secure a copyright registration for the film until after it began
collecting information on peer-to-peer traffic, and argues that this fact
invalidates any earlier claims of infringement.

Supreme Court Rejects Convicted Teen File-Swapper's Appeal

0

Washington – The U.S. Supreme Court has declined to hear an
appeal from a convicted teenage file-swapper, who had argued that the amount of
damages she was ordered to pay should be reduced because she didn’t realize she
was infringing copyrights, the Associated Press reported.

Whitney Harper was 16
years old when she was sued by record labels for copyright infringement, and
had argued in court that she was an "innocent infringer," not aware
that sharing music on peer-to-peer networks was illegal.

AP notes that Justice
Samuel Alito dissented in the Court’s rejection of certiorari.

Reuters: Microsoft, Networks in Talks on TV Subscription Service

0

New York – Microsoft (NASD: MSFT) has held discussions with TV networks
on licensing programming for a new paid subscription service, Reuters reported,
citing two people familiar with the plans.

The talks have included a proposal
to create an online "virtual cable operator" system, where Microsoft
would collect a monthly fee from subscribers.

The company has also proffered
its Xbox 360 game console as a potential authentication device that could
provide existing cable subscribers with online access to their subscribed
channels.

Sources told Reuters that early discussions were
"productive," although such a service may be a year away from launch.
