Baltimore, Md. – Apple (NASD: AAPL) and AT&T (NYSE: T) now face a class action
lawsuit alleging they distributed the iPhone 4 knowing it had a malfunctioning
antenna, in the wake of reports of signal loss when the phone is gripped in a
When users complained of lost reception when holding the iPhone 4 in
their left hands, Apple responded in a statement that, "gripping any phone
will result in some attenuation of its antenna," and suggested that users "avoid
gripping it in the lower left corner in a way that covers both sides of the
black strip in the metal band, or simply use one of many available cases"
as a solution.
The lawsuit also cites evidence including a reported internal
memo wherein Apple customer service representatives were told not to provide
warranty service on the issue.
The class action lawsuit seeks unspecified
monetary damages, and an injunction against the future sale of iPhone 4 units
with defective antennas.
