Apple has won the latest battle in the legal fighting between it and Samsung, resulting in a U.S. district court judge approving a preliminary injunction blocking sales of Samsung’s Galaxy Tab 10.1. But the war most certainly isn’t over.
For one thing, Apple’s victory only applies to that specific model in Samsung’s line of tablets (pictured), which is no longer the most recent one. For another, Samsung has already filed a motion to appeal.
Samsung also released a statement on the situation. “Should Apple continue to make legal claims based on such a generic design patent, design innovation and progress in the industry could be restricted,” the Korean giant said.
But meanwhile, Apple must post a $2.6 million bond, so that Samsung can get some relief from damages should the injunction be overturned in the future.
“Although Samsung has a right to compete, it does not have a right to compete unfairly, by flooding the market with infringing products,” U.S. District Judge Lucy Koh wrote in her decision. She had previously denied the injunction but reconsidered after a federal appeals court instructed her to do so.
