Report: Rapidshare Nixing Accounts of Media Downloaders

Berlin
– Rapidshare, the Germany-based file-hosting service that has come under fire
for hosting unauthorized copyrighted content, has in recent weeks begun to
target users uploading or downloading copyrighted files by terminating their
accounts and logging IP address data, TorrentFreak reported.

It’s unclear how
widespread the new tactics are at this point, as Rapidshare attracts millions
of monthly visitors.

The company has become an increasing target of copyright
holders as users saw Rapidshare and similar services as less prone to liability
than traditional file-sharing networks.

In late 2009, the company was reported
to be disclosing user IDs to copyright holders.

Last year, the company was
ordered by a German court to proactively block some 5,000 songs controlled by
copyright society GEMA from its service, and in February, a court ordered
Rapidshare to proactively block textbook uploads to its service.

However, some
in the content industry have at least experimented with the service’s distribution
potential — including Time Warner’s Warner Bros., which in 2009 partnered with
the company to create RapidMovies, a site that served movie trailers and hoped
to eventually sell movie downloads.

Report: Smartphone Motion Control Patent Could Roil Industry

New York – A relatively unknown firm called Durham Holdings
has won a broad U.S. patent for technology that describes the use of motion to
control the interface of a smartphone — a feature present in the iPhone and
many other smartphones from Palm, Motorola, Google and others, All Things D
reports.

The patent application was filed in 2006, before the introduction of
the first smartphones to feature motion-sensing accelerometers, and pre-dating
several of Apple’s key motion-related patent applications, the report noted.

It’s unclear at this point whether Durham
will seek to aggressively license its patent.

DRM Firms Verimatrix, Widevine Settle Patent Dispute

– Verimatrix and Widevine Technologies, two providers of digital rights
management (DRM) and anti-piracy technologies, announced on Wednesday that they
have settled a pending patent infringement lawsuit.

Widevine sued Verimatrix in
August 2007, alleging the company’s VCAS products infringed two of Widevine’s
patents, related to technology that encrypts content over a network.

Under the
terms of the settlement agreement, Widevine granted Verimatrix a license to the
two patents, while Verimatrix made no admission as to infringement of the
patents.

Ex-Sony Music Head Debuts IMHO Social Content Player

– IMO Entertainment, a start-up founded by former Sony (NYSE: SNE) Music and Columbia
Records head Don Ienner, on Wednesday launched a preview of its flagship
product, an embeddable content player with social and monetization features.

The
IMHO player "enables users to communicate with friends, make content
recommendations, share experiences and purchase merchandise associated with a
wide range of content," and features a ‘hybrid’ platform that lets users
pay for access to content with either cash or by viewing advertising.

The
company launched a preview of its technology on Melodeo’s nuTsie service and online
music platform OurStage.com, and is conducting public scalability tests with
various media content with Facebook users before a full open beta test is
launched in the spring.

The IMHO player will offer music from digital
distributor The Orchard; Web radio powered by nuTsie; casual games from
RealNetworks; and over 1,600 films from Sony Pictures, Warner Bros., Lionsgate,
Paramount and others via a distribution deal with Film Fresh.

Fox Introduces Bitbop Mobile Video Subscription Service

– News Corp.’s (NYSE: NWS) Fox Mobile Group on Wednesday introduced Bitbop, a forthcoming mobile
video subscription service that will offer full-length TV shows and movies for streaming
or temporary download to smartphones.

The service $9.99 per month service will
deliver content — presumably from Fox and other providers, although none were named
in the announcement — to smartphones over Wi-Fi or a 3G connection.

"Working
across most carriers and a wide variety of devices, Bitbop’s technology can
move the data robustly over the pipeline, providing a picture that exceeds
expectations," said Fox Mobile Group chief technology officer Markus
Thorstvedt.

Google Addresses Concerns on Access to Gmail, Apps in China

– In the wake of its
decision this week to stop censoring search results in China, Google (NASD: GOOG) addressed
potential concerns companies may have that China may take action to block other
Google service used by enterprises, such as Gmail and Google Apps.

"We
very much hope that the Chinese government respects our decision, though we are
well aware that China could at any time block access to our services in
mainland China," the Google Apps team wrote in a blog post.

The company
created a new Web page that will monitor the availability of Google Apps in China.

It also
encouraged companies to take advantage of available network technologies, such
as a Virtual Private Network (VPN), secure shell (SSH) tunneling or proxy
servers as a means of enabling employees in China to freely access Google’s
services.

"We recognize that these issues are not unique to Google; many
technology companies serving users in China face challenges in providing
access to their services, and we don’t see yesterday’s news changing how we
serve you moving forward," the company said.

Swaptree Raises $4.7 Million for Media Trading Service

– Swaptree, an online, service that allows users to trade books, CDs, DVDs, and
video games, has raised $4.7 million in a round of venture capital, according
to a regulatory filing.

Founded in 2004, Boston-based Swaptree lets people list
the consumer media products they want to trade and receive.

The service then
shows which items they can receive in exchange for their own.

Once the trade is
accepted, users are provided with shipping information.

Icahn Charges Lionsgate Board Has "Failed Shareholders"

– Activist investor Carl Icahn on Wednesday called out the head of Lionsgate (NYSE:  LGF),
the film studio for which he has made an unsolicited takeover bid, detailing
how he believes the company has been mismanaged in recent years. Icahn
questioned Lionsgate head Jon Feltheimer’s assertion that the company has
steadily built shareholder value over the past ten years, noting that most
appreciation came with its acquisition of Artisan in 2004, while the share
price has remained stagnant or fallen since then.

"If the stock price of a
company remains stagnant for years, as it has with Lions Gate, then clearly
something is wrong. I suggest that your directors have failed
shareholders," Icahn said in his open letter to Feltheimer.

Icahn further
attacked Lionsgate’s hopes to acquire the film libraries of MGM and Miramax.

"I
am fearful that you have determined to ‘swing for the fences’ using excessive
debt and risking the shareholders’ equity," Icahn wrote.

"The road to
bankruptcy is littered with companies whose CEOs — under the banner of
‘vision’ — have been permitted by lax board oversight to gamble their
companies into oblivion."

Lionsgate responded by saying that Icahn’s
letter is "simply attempting to distract shareholders from the obvious —
his offer price is woefully inadequate."

The studio also alleges that in
discussions with management last year, Icahn mentioned potentially providing
financing for the company’s proposed acquisition of MGM, and is now
"openly criticizing Lionsgate for its interest in acquiring
libraries."

It also said Icahn was openly critical of its
acquisition of TV Guide Network and TVGuide.com last year, but has since
praised management for the decision.

The company concluded by saying that it is
"confident we can better serve our shareholders by continuing to execute
our strategic business plan."

Study: Radio Ad Revenue Poised for Steady Upswing

Va.
– Following several years of
falling revenue, the radio industry is expected to see slight ad revenue
increases in 2010, according to a new report by media advisory firm BIA/Kelsey.

The firm predicts industry revenue growth of 1.5% this year and 2-4% over the
next few years.

That includes a projected 16.5% compound growth rate from web
and other online sources.

"While the poor economy held it down
momentarily, radio is coming back to demonstrate that it is an important
advertising vehicle, particularly in local media markets," said Mark
Fratrik, vice president of BIA/Kelsey.

"The industry will continue to grow
its online revenues in 2010 as increasingly more progressive radio groups
recognize they are more than just over-the-air transmitters and begin to
integrate cross-platform promotions with their broadcast and web
operations."

Washington’s
WTOP ranked second in the nation in terms of the revenue last year, at $51
million.

It was the only local station to crack the top 10, which featured
seven stations from either New York or Los Angeles.

Mobile Marketer Vibes Media Acquires Zeep Mobile

– Vibes Media, a provider of mobile marketing services, announced on Wednesday
that it has acquired Zeep Mobile, a developer of mobile ad delivery technology.

Financial terms of the deal were not disclosed.

Founded in 2008, Zeep claims a
network of 10,000 developers works with its technology that helps monetize SMS
traffic for publishers.

Chicago-based Vibes said it will integrate Zeep’s
technology into its existing mobile marketing software, and announce new
offerings for publisher and marketer clients in the coming weeks.
